The "rules" of marriage and divorce were probably intended to be a lot more based on community or church elders and their knowledge of the couple, than a codified law about the particulars. Of course, everything crossing into American borders has to be centralized, and here we are, untrusting of the convictions of people who should be making those kinds of judgments.
